General memberships are one thing, but many employee assistance programs today involve medical information. As such, when the services of an EAP are provided to an employee, even though those services may be paid by the employer, the employer has no right to access the employee’s medical record.

The only time an EAP health professional could release limited information is if the employee signs a consent and release form.
